Assim, se uma imagem for publicada sem autorização, já existirá o direito à indenização, ainda que a publicação não atinja a intimidade ou honra de uma pessoa ao ser publicada. Ou seja, a exposição indevida de alguém gera dever de indenizar. Se atingir a intimidade ou honra, passa a ser crime também.

Por esse motivo, deve-se ter cada vez mais cuidado com o que se compartilha nas redes sociais, grupos de Whatsapp e em outros meios eletrônicos.

A imagem, sendo um Direito da Personalidade não pode ser transmitido e/ou renunciado pelo indivíduo (já que é direito constitucional), porém, se for vontade da parte, é possível que se realize uma cessão de uso da imagem, por meio de contratos específicos.
